RELEASE FORMS
Our insurance company gave us equipment maintenance check lists and advice to prevent accidents, but not a word about requiring release forms. This could indicate that they don't have much faith in such forms. If a member should have an accident, release forms and disclaimers are generally invalid in a court of law. Still, almost every gym and fitness facility requires you to sign a release form. Better safe than sorry.

Usually the release forms and disclaimers are part of membership contracts, but the main purpose of such contracts, concerns collection of membership payments.

If you are going to offer memberships, you may be required by state law to have a bond or other form of financial security to protect members in the event the club closes. See below:

New York State law requires certain clubs to have a bond or other form of financial security to protect members in the event the club closes. YOU MAY ASK A REPRESENTATIVE OF THE CLUB FOR PROOF OF THE CLUB'S COMPLIANCE WITH THIS LAW. YOU MAY ALSO OBTAIN THIS INFORMATION FROM THE NEW YORK STATE DEPARTMENT OF STATE, DIVISION OF LlCENSING SERVICES, 162 WASHINGTON AVENUE, ALBANY, NEW YORK 12231
